Senior Legal Counsel, Discovery/ Litigation, Investigations, and Regulatory Enforcement Legal Department This position will manage and advise on the full end-to-end discovery lifecycle, procedures, and policies and will report to the Senior Legal Counsel of Litigation, Investigations, and Regulatory Enforcement.
Discovery Counsel will be expected to manage legal workflows across a wide array of complex litigation, investigation, and regulatory enforcement matters to support the discovery process in accordance with industry standards and will ensure compliance with any discovery obligations.
Discovery Counsel will also collaborate with Outside Counsel in the preparation of Electronic Stipulation Information (ESI) pleadings, Protective Orders and other pleadings related to the management of the discovery process and will further have direct responsibility in managing data retention and disposition policies, data collections, document productions, and privilege logs.
Major Duties:
o Providing day-to-day legal advice regarding data and discovery issues to attorneys, paralegals, project managers, and other members of the discovery team across an array of legal matters.
o Serving as subject matter expert on discovery best practices and discussing such issues with both technically skilled individuals as well as those without discovery exposure.
o Managing the custodian interview process, including working with more senior and more junior attorneys to develop a custodian interview strategy and investigating identified data repositories to ensure proper preservation and collection of data.
o Representing the legal department in interactions with a variety of internal stakeholders to ensure that data can be preserved for legal hold and discovered as necessary.
o Evaluating, reviewing, and managing third-party discovery vendors.
o Supporting partners in Technology, Data Governance, Privacy, and Compliance to ensure that legal hold and discovery needs are built into ongoing data governance, retention, and related practices.
o Evaluating current discovery practices and providing practical guidance to improve upon those practices and ensure alignment with industry best practices.
o Researching and assessing legacy data repositories as well as new applications and systems coming online in order to make recommendations for data preservation and discovery efforts.
o Supervising other team members with responsibility for conducting research and gathering data for legal matters.
o Learning and continuing to stay apprised of new developments and regulations in discovery related litigation.
Skills/
Qualifications:
The successful candidate will benefit from having:
o JD required.
o Attorney candidates must be in compliance with all relevant licensing requirements, including the requirements of the jurisdiction where the role will be located, prior to commencement of employment.
o Must possess at least 8-10 years of litigation discovery experience in a law firm or in-house legal department.
o Candidates must have demonstrated experience advising on complex legal requirements pertaining to data and discovery in state and federal courts, and preference will be given to candidates who have at least some experience addressing data and discovery issues in international legal proceedings.
o Must have a good understanding of and familiarity with data hygiene and data governance practices and be able to advise business and technology stakeholders to enable the implementation of legal hold and discovery best practices.
o Extensive knowledge of and interest in litigation discovery across the EDRM model and ability to synthesize and apply discovery best practices in a range of contexts.
o High level of proficiency with technology including Litigation Support Applications such as Relativity or other hosting technologies as well as Legal Hold applications such as Exterro.
o General knowledge of IT infrastructures, including networks and other sources of data.
o Experience with litigation in state and federal courts.
o Strong analytical, problem-solving and legal research skills.
o Strong business judgment, strategic thinking, and client counseling skills.
o Proven ability to independently identify issues, analyze problems, and provide viable solutions.
o Excellent verbal, written, interpersonal, organizational and negotiation skills.
o Ability to communicate and interact effectively with all levels of personnel and management, including senior executives.
o Ability to work under pressure, handle deadlines, and manage multiple tasks in a high- performance environment.
o Ability to follow up on assignments in a timely manner, exercise good business judgment, and work accurately under pressure.
o Excellent interpersonal skills and ability to build consensus across a global matrix organization.
